Foreclosure of hypothec

This study consists of a total of five chapters, namely introduction, three main chapters and conclusion. In the first chapter, general information about hypothec which is the basic concept for our study, is given. The definition, subject and scope of the hypothec and its features are explained. In addition, the conditions of establishment of the hypothec and its types are emphasized. In the second part, the rule of firstly applying to the pledge and the prohibition of lex commissoria are discussed. Transfers of mortgaged immovables, which are within the scope of the prohibition or not, are explained with examples. In the third part, information about foreclosure of the mortgage within the scope of the Execution and Bankruptcy Law is given. In addition, solutions for the problems encountered during foreclosure are presented. In the second and third parts of our study, Supreme Court decisions on the subject have been utilized extensively. In the conclusion part, the conclusions and solution suggestions based on the examinations in our study are outlined.
