Abstract (EN)

This thesis aims to evaluate AI-supported video interview applications used in assessing job candidates' suitability in hiring processes from the perspective of labor law and personal data protection law. The first chapter examines the stages leading up to the establishment of an employment contract, explores how artificial intelligence technologies are utilized in human resources management with the digitalization of this process, and outlines the legal framework of the recruitment process. The second section focuses on the function of AI-supported video interview systems and evaluates the advantages and disadvantages of supporting the recruitment process by processing data such as facial expressions, body language, voice, speech, and the candidate's emotions for employers and job applicants. In the context of the potential legal and ethical issues discussed, concerns about algorithmic discrimination, the possibility of bias in the decisions made by the systems, and the lack of transparency in the decision-making process come to the fore. In the third chapter, the legal nature of the personal data of job candidates whose suitability for a job is evaluated by an AI-supported system, the conditions for processing this data, the obligations of the data controller in this process, and the legal sanctions that may arise in the event of unlawful data processing are explained. The evaluation is made within the framework of relevant legislation, primarily the Personal Data Protection Law. At the end of the thesis, recommendations are made regarding the need for greater transparency in the use of AI-supported video interview applications in recruitment, increasing the impartiality of the data used in the training of AI algorithms, and the need for legal regulations specific to this field. The study is based on the idea that technological developments affecting and changing recruitment processes must progress in harmony with fundamental rights and freedoms and legal principles; it analyzes new-generation recruitment methods within the framework of legal discipline.
