Overwork in Labor Law

Regarding economical and technological improvements, regulations were needed due to provide flexibility in working hours.In 4875 Labor Law, which created according to strict regulations of Labour Law 1475, there has been a claim for a balance between workers health and employer. Therefore some regulations have been applied, working hours and overworking hours reorganized and instead of overcharging overworking hours, free time has been considered and applied. The changes and innovations that are applied, overworking and over time working hours, regulated by the Labour Law 4857 article 41-43 and Turkish Law Of Obligations article 398 and 402, also the legislation of overworking and overtime working in Labour Law, which entered in to force in 06.04.2014. Due to the challenges which came with the professional life and needs, employers continue to exceed working hours of employees in the range of weekly and daily bases. This brought the concept of overtime working and overworking. The study has been maintained about overworking and overworking hours in Labour Law, The overtime working and overworking hours named labour law No: 4857 in article 41-43. and the Turkish code of obligations article 398 and 402 has been entered the force in 06.04.2014. According to Overtime Working and 4857 Labour Law guidelines, "The overtime working is determined by the working hours that exceeds 45 hour in a week." Overtime working definition both enters in the old laws and in the new regulations that is in law no:4857 that named overworking hours. In Labour Law no:4857 according to overworking regulations, " Overworking hours, by the accordant, determined as the working hours that reaches up to 45 hours in a week."
