Abstract (EN)
Release agreement is the termination of a debt relationship between the parties by the creditor in favor of the debtor. The release agreement was not regulated legally in the period of the Code of Obligations No. 818, its implementation was left to doctrines and judicial decisions. During the period of Law No. 818, the rules to be subject to the release agreement were basically determined by taking advantage of the provisions on release in the Swiss Code of Obligations of 1911. For the first time, the release agreement was taken under the Turkish Code of Obligations No. 6098 and regulated legally. In terms of labor law, the release agreement is called as "ibraname" (release). In business relations, release generally appears as the employer to free the employer from debt for his receivables from the employer. In this study, the application forms of the release in the period of Law No. 818 and Law No. 6098 will be explained in detail with doctrines and judicial decisions.
