Abstract (EN)

The purpose of this study is to analyze the legal problems that arise in labour relations from the viewpoint of bioethics. The discipline of bioethics tries to resolve the ethical and moral dilemmas presented to us by modern medicine. While the foundation of bioethics actually focus on the ethics of medicine, the bioethical approaches are trying to resolve problems that coincide with the sphere of the law. Various problems within Personal Law, Family Law, Labour Law, or Social Security Law are of a nature that are also encompassed within the boundaries of bioethics. The constant advance of the biotechnologies point to various violations that may infringe upon an individual's personality and private life. For example, the wish to learn the personal data regarding the employee's health and to conduct certain tests to reach this objective may constitute an unlawful practice. In order to resolve such issues, the common problems that both bioethics and labour law are trying to resolve must be clearly defined. As a result, this study considers the legal consequences of the tests on genetics, HIV, alcohol and drugs conducted within labour relations.
