Administrative sanctions for failure to meet occupational health and safety obligations

When the occupational accidents and the losses experienced in these accidents are taken into consideration, the importance of the measures to be taken regarding occupational health and safety is more clearly seen. We have determined our working position in this field because it is closely related to human health and life. Our study consists of three parts. In the first part, we will discuss the concepts of occupational health and safety in general. Here draw the conceptual framework of occupational health and safety, the importance of occupational health and safety, the legal nature, historical development and the responsible institutions in Turkey that we will discuss which ones. In the second part, we will try to explain the rights and obligations of employers and employees about occupational health and safety. In this section, we will mainly mention the obligations of employers on occupational health and safety, as well as the rights and obligations of employees. In the first two chapters, we will explain the occupational health and safety issues and determine the employer's obligations. In this sense, we will discuss in detail the administrative sanctions in the current system for the suspension of work, administrative fines, prohibition of workers from working and the prohibition of public procurement due to fatal work accident. We will address in more detail the halting of the work and the sanctions of administrative fines in comparison to other issues, in order to have an immense and large impact in terms of its impact on the workplace, the employer and the work. In addition, we will include incentive arrangements included in our legislation in recent years. Although we will form our work within the framework of the Occupational Health and Safety Law No. 6331 in force, we will not refrain from mentioning the abolished laws and other legislation where necessary. We will also benefit from the doctrine and judicial decisions in the interpretation of the legislation.
