Employment of foreign worker according to labour and social security law

According the Constitution, everyone is entitled to the right to work. However, Article 16 of the Constitution states that this right, which is also recognized for foreigners, may be restricted by law. The state has established rules by law for access to labor market by foreigners. In this context, foreigners are required to obtain a work permit in accordance with the International Labor Law No. 6735 in order to work in our country. The Ministry of Family, Labor and Social Services has been designated as the competent public authority in granting work permits. The Ministry establishes an international labor policy for long-term planning for the employment of foreigners with the participation of social partners. The International Labor Law No. 6735 includes the processes of work permits, types of work permits, employee and employer obligations, and work permit exemption provisions. The types of work permits stipulated in the law will also be effective in determining the types of employment contracts in labor relations of foreigner. Employment of foreigners without a work permit or performing the professions that are prohibited will affect the validity of the employment contracts.
