Abstract (EN)
The subject of the thesis is Underperformance as a Valid Cause for the Termination of The Employment Contract. The thesis consists of three parts. In the first section, performance and productivity concepts are introduced; several performance evaluation methods are examined, the errors done while evaluating the performance and the usage areas of performance evaluation are analyzed. In the second section, the underperformance, objective and subjective criteria as the criterion for the underperformance are introduced. Thereafter, it is discussed as to how these concepts are approached with regards to the judgments of High Court of Justice and Doctrine opinions. In the third section, the termination of the employment contract with a valid cause is explained. The proof of the termination with a valid cause is evaluated in terms of the termination type of our study. Lastly, the terms of the termination of an employment contract with a valid cause based on underperformance is presented in the light of the decrees of the High Court of Justice.
