Abstract (EN)

Act No. 6356 on Trade Unions and Collective Agreements, as in the repealed Act No. 2821 on Trade Unions, has perceived the industrial unionism as the basis for unionisation. Although the business line is primarily concerned with the foundation and organization of a trade union, it is directly influencing the use of many trade union freedoms until the determination of the authorized partner in collective bargaining which workers belong to. Because of this reason, the importance of the clarification owning business line and the importance of the determination of worker's workplace has led us to work on this issue. In this work, the principle of unionization on the basis of industry and in comparison with the regulations contained in the articles of the law will be thoroughly examined together with the views of the doctrine and judicial decisions. While the subject was examined, a large literature search was made and referring to international conventions on the subject. Moreover, judgments of the judicial organs in our country have often been referred in all aspects. It is aimed that the problems who encountered during the trial would be assisted such as the employee, employers and their unions as well as the administrative units that identify the business line in the administrative phase as a result of examining the subject at master's thesis level.
