Abstract (EN)

At the begining of the mankind history, people used the natural sources for their basic needs. Newertheless from the first day, humanity have been searching for an ease and relief life style. As a result of this tendency, in the name of to get their demands, mankind improved some sorts of commercial ways. Like; association, trading, purchasing, borrowing, renting and etc. Initially, people started to trading as barter. Then, with the invention of the money, they have made their commercial life more easiness in time. Throughout the history, especially gold had been the major player of the fund and trading life. Instead of other mines or materials, gold mostly used by people for both commercial relations and gathering. When we came our century, banks interested in gold so much as well. Primarily, banks used gold just for deposit accounts. In course of time, with the aid of the experts, banks start to give facilities to society with gold for deposit and drawing accounts and gold stock. From the view of Canon Law, because of the gold is the main object, gold account becomes to expenditure contracting's topic. Besides, because of the gold is invest in to bank account as buying registration, it brings Contractual Debt's features and adjudications. Therefore, the gold accounts bring both Canon Law's and Contractual Debt's characteristics and it is an actual and mixed contracting's subject that needs to mutual agreement. According to deposit and participation banks, the gold account has different conditions. And in this respect, the account evaluated for terms of Canon Law. As well as, demand current gold accounts are evaluated as Canon Law Contractual Debt's contracting like turkish liras or US dollars account, deposit gold accounts are like Contractual Debt's contract which has interest elements and gold participations accounts evaluated as labor-capital partnership contract respectively.
