Abstract (EN)
In our study, the nature and causes of hardship, which is an inseparable part of human life, the solutions Islam offers to alleviate hardship, and the main legal consequences of hardship are discussed. Within this context, particular attention is given to types of sales (bey') that are permissible despite being contrary to analogy (hilâfu'l-kıyâs) in the realm of transactions (muâmelât), and the aspects of hardship they address are analyzed. The study does not adhere strictly to the views of any particular school of thought but attempts to discuss the general perspectives of Islamic schools regarding the alleviation of hardship. Our study is divided into three main sections. The first section explores the concept of hardship and related terms, providing an overview of its nature, identifying its causes, and addressing its impact on human life. The second section examines universal legal principles (küllî kâideler) that contribute to alleviating hardship and evaluates their implications for human life. In the final section, the significant legal consequences of hardship are discussed. Within this framework, types of sales permitted outside the scope of analogy are identified, and their connection to hardship is analyzed. Additionally, some sales types deemed permissible by analogy that are thought to be effective in mitigating hardship are also addressed. The study concludes that Islam aims to ease the material and spiritual burdens of individuals, offering solutions to free them from the difficulties they face. However, as hardships and individual responses to them vary, Islamic law adopts a gradual approach to their alleviation. Similarly, certain situations that are generally considered impermissible are deemed permissible based on necessity, with the removal of hardship recognized as the ultimate goal.
