Abstract (EN)
Autopsy is the examination of the inside of the dead body. In general, autopsy is divided into three as forensic autopsy, autopsy related to the disease and scientific (medical) autopsy. Today, autopsy is very important for the diagnosis and treatment of diseases, the advancement of medical science and to clarify the cause of death in suspicious death cases. In this qualitative study using the literature review method, whether autopsy is permissible according to Islamic law has been revealed in the light of classical Islamic sources with its evidence. According to the fatwas given by the fuqaha on subjects comparable to autopsy, the evidence of Islamic law and the universal principles of Islamic law, autopsy was deemed permissible as a necessity for the manifestation of justice, diagnosis and treatment of diseases. However, the permissibility of cadaver autopsy depends on certain conditions. In this study, the opinions of those who do not allow autopsy are also mentioned and the objections to these views are included. In the introduction part of the research, information about the thesis is given. In the first part of the research, the nature and history of the autopsy, the concepts related to the autopsy and the stages of the autopsy are mentioned. In the second part of the research, the provision of autopsy according to Islamic law, the opinion that autopsy is permissible, the opinion that autopsy is not permissible, the conditions and penalties of autopsy, the benefits of autopsy, the purchase of cadavers and autopsy in positive law are mentioned.
