This research dealt with the crime of theft as one of the most important crimes that legislation in the past and recent times have been interested in regulating; Because it constitutes an attack on people's money that is forbidden to those who are not its owners، and it has been shown through the research of the Qur'anic miracles in the penalty of theft through the strict punishment that does not include softness or looseness to eradicate this crime and ward off its danger from society، as I dealt with in this research ways to prove the crime of theft In Islamic jurisprudence and Iraqi law in an attempt to identify the points of agreement and differences between them. The research included an introduction and two chapters. In the first chapter، I talked about what the crime of theft is in Islamic jurisprudence and law، where theft was known in jurisprudence and law through the first topic، linguistically and idiomatically. On the methods of proving the claim of theft in Islamic jurisprudence and law، and in the second topic the penalty for the crime of theft in Islamic jurisprudence and law. Among the most important results that I came out with: In the crime of theft that is legally expressive، which requires the limit، it is required that the taking be hidden، and the law contrasts it with the fact that the embezzlement is complete، and is achieved by the lack of consent of the victim. The fact that the place of theft was money، and other results that I reached in this research. Then I appended the research with scientific indexes to make it easier for the reader to find out what he wanted...
