Abstract (EN)
In this thesis, it has been discussed the transfer of the property or the temporary benefit to the opponent side for a price. Our thesis consist of an introduction and three chapters. In the first chapter, it has been examined the concepts of receiving (Qabd), related contract with receiving, price, ownership, spending and delivery. In the second chapter, it has been examined the receiving and its real nature. It has been studied and interpreted the priority right in the receiving. In the third chapter, it has been emphasized on actual results of receiving and it has been researched the sale agreement in the transmission of the property and rental agreement in the transmission of benefit. İt has been introduced provisions of spending in the price and goods before delivery. And it has been studied its reflections to the contemporary issues.
