Artificial intelligence problem in the context of personality in Islamic law

In this study, "Artificial Intelligence Problem in the Context of Personality in Islamic Law" was discussed. In this context, the problem of artificial intelligence is discussed in three parts with different aspects. These are the relationship between artificial intelligence and the human brain, its definition and parts, and the examination of its philosophical background. In fact, artificial intelligence is an algorithm. The area where this algorithm is tried to be make similarity is mostly the human brain. For this reason, a solution has been sought for why artificial intelligence is needed and why its legal infrastructure is a problem. Assuming that there is a need to evaluate artificial intelligence in the context of personality according to Islamic law, artificial intelligence has been compared with the factors that affecting the human personality. In this study, some evaluations were made in the context of spirit, will, mind and fitra (nature) (The Fitra-related (nature-related) transhumanity, and also artificial intelligence and marriage with artificial intelligence in terms of the problem of the continuation of the posterity were discussed in the centre of the facts revealed in terms of Islamic Family Law) by assuming the artificial intelligence in a human-like, robot-shaped body as a legal personality is accepted as the main problem. Considering the development of artificial intelligence law, the value problem of artificial intelligence in Islamic criminal law and the crimes committed due to the criminal capacity of artificial intelligence and the method to punish these crimes are expressed by making legal norm-based explanations. In this sense, it has been pointed out that who produce, program and use artificial intelligence should be held responsible for the possible dangers, especially in crimes caused by perfect responsibility oriented artificial intelligence. In particular, it is suggested that the property status proposal of artificial intelligence will be the most appropriate evaluation in terms of Islamic Law.
