Abstract (EN)
In this study, which is discussed under the title of defendant rights in Islamic law, the issues that related to defendant, the difference between defendant and suspect, the history of defendant, defendant rights and principles are examined. Although Islamic law is the basis of the study, the relevant part has been tried to be approached comparatively with modern law as the occasion arises in order to better understand the issue. In addition, regardless of the opinion of any sect, the issue has been tried to be discussed in detail. As a result of the research, it is seen that the defendant rights in Islamic law were discussed in almost all sects under different titles. The existence of some rights which are absent in modern law due to its structure have been detected in Islamic law. The defendant rights that detected were approached with a dual classification of the defendant's choice and not. Keywords: Defendant, suspect, right, principle, right of defendant
