Suftaja in Islamic law

In this study, the practice of "suftaja", which refers to the payment of the debt in another location, is discussed and analyzed in terms of Islamic Law. The practice of suftaja was disapproved by early jurisprudents due to the possibility of the lender's intention to impose the possible risks and transfer costs on the borrower. Later fiqh scholars, on the other hand, stated that such a practice is generally permissible if it is done for the purpose of favoring the addressee without any conditions. In our study, the conceptual framework of suftaja, the legitimacy debates, the elements of suftaja and its application have been investigated. Our thesis consists of an introduction and two chapters. In the introduction, introductory information about suftaja is shared, its position in trade is mentioned and some studies on this subject are mentioned. In the first chapter, the word suftaja is analyzed, some related terms are discussed, and the legitimacy debates on the subject are presented. In the second part, suftaja is discussed in terms of its elements and application, historical experience is given and some special provisions are presented. Finally, our study is concluded with a conclusion that includes our personal evaluations. Keywords: Islamic Law, Suftaja, Karz, Remittance, Interest.
