Abstract (EN)
In this study people with intellectual disabilities are investigated into the status of liabilitiy and license according to Islamic law and Turkish law. This subject is examined in terms of the factors of license and mental disabilities are evaluated according to their ability to distinguish. The results showed that agressive middle and advanced mental retardation did not have the distinguish. The results showed that agressive middle and advanced mental retardation did not have the distinguish power and for this reason it would be more appropriate to evaluate the extent of insanity. Mild mental reterdation has the power to distignguish but it is doubtful about puberty. For this reason, it should be assessed within the scope of senile. But unlike the view of society about senile of worship these people have a limited obligation to worship. These who have intelligence reterdation at the border despite having the condition of distinction and adolescence due to lack of puberty accapted within the scope of mindless.
