The purpose of the thesis is a comparison of the theoretical and practical Islamic Law. As the main source of this study has been used Manisa court records (A.C. 1625-1650) and classical Islamic Law (Fiqh) literature.The aims of thesis, method which is used, general political and cultural aspects of the period and some of the important studies on the judicial records were emphasized in the introductory chapter.In the first chapter, judges and justice system in the Islamic and Ottoman law are discussed and basic sources of Fiqh that affects to the Ottoman law is introduced. Moreover, the Ottoman legal structure, functioning of the courts and importance of court records are also emphasized.In the second chapter, the family law practices that observed in the court records of Manisa have been discussed and analyzed according to the principles of Islamic family law.In the third and final chapter, the criminal law practices that found in the judicial records of Manisa have been discussed and evaluated in accordance with general principles of Islamic criminal law.
