Abstract (EN)

This study involves examining medical malpractice (malpractice) at all stages of medical interventions in gynecological and obstetric clinics. The purpose of the work is to ensure that the health personnel working in the field of gynecological diseases and obstetrics are informed about the damages that may occur if they do not perform standard medical practice. To help them to find solutions by providing awareness of situations arising from lack of professional knowledge and skills and to warn them about the legal obligations caused by not giving treatment to the patient and to examine the errors caused by the health personnel in medical malpractice. Moreover, in the last two years in the study, decisions of the Supreme Court of Appeals in the field of gynecological diseases and birth have been given. In this way, it is possible to have information about the cases in this area. In the first part, the rights and obligations of the patient and the physician, as well as the definition of medical intervention and medical practice error, are included. In addition, medical intervention was assessed in different ways, and medical practice errors were examined from a legal point of view. In the second chapter, the medical mistakes in the gynecological and obstetric clinics and the decisions of the Supreme Court and Council of State have been evaluated.
