Abstract (EN)
There is a basic relationship between the parties in bills of exchange as a rule. The right contained in the bill of exchange is a right independent of the basic debt relationship. In order to claim the right arising from the bill of exchange, the determination of the title of the principal debtor has an important place. In case of acceptance of the deed bill of exchange the addressee is the debtor and the issuer is the principal debtor of bond and checks. In order to collect the receivables, the holder has the opportunity to apply for the right of demand and follow-up arising from the bills of exchange, transfer the provision or collect the receivable based on the basic relationship. One of the right request arising from bills of exchange is the lawsuit for unjust enrichment arising from bills of exchange regulated under article 732 of the Turkish Commercial Code. In order to sue for unjust enrichment arising from bills of exchange the deed must be time-barred or the holder must lose right to apply to the debtors. In our study, the purpose of regulation the unjust enrichment of the institution of bills of Exchange, its similarities and differences between and the institution of unjust enrichment under Turkish Law of Obligations, institutions of relying on the basic relationship and transfer of provision, which is an alternative legal way, explanation of concepts such as prescription in bills of exchange, acceptance, payment, non-acceptance - non-payment protests and subjects such as the legal nature of the unjust enrichment lawsuit arising from the bills of exchange and the conditions of application are included.
