Abstract (EN)

Negotiable instruments are defined in Turkish Trade Law 645: "Negotiable instruments are the bills contains the rights, which neither could be transfered nor could be exercised independently of the bill itself". We understand that the right could not be separated from the bill by the defination of the Code. Bill of Exchange is the most common type of negotiable instruments in practical terms. In consequence of that, the right which is contained by Bill of Exchange, neither could transfer nor could exercise independent of bill itself. The main purpose of this thesis is to explain bill of loss and the rights owner of the bill has which legal remedy toward to bill of loss. Also in this essay, some problems accure in practical terms (prohibition of the payment by the drawer of the bill and if the drawer of the bill has the right to demand for cancellation or not, if the bearer of the annulment decision could refer to endorser or not etc.) will be mentioned, will be given some suggestions in he light of doctrine and jurisprudence and will be searched for a solution.
