Abstract (EN)

Public-Private Partnership (PPP) projects stand out as a business model that has become increasingly widespread throughout the world, especially in recent years. This model has emerged in order to use public resources effectively, to increase the quality of public services together with the use of experience, capital and technological capacity of the private sector. The fact that Turkey has gained a serious momentum in this field, has realized PPP projects in many sectors and the total amount of these projects reaches 5% of the national income, increases the importance of this model in our country. However, the legal dimension of PPP projects is an important part of the success of this model. Because the legal validity of the contracts between the parties involved in these projects and their correct implementation at all stages of the cooperation process play a critical role in the success of the projects. In addition, legal problems frequently encountered in PPP projects need to be addressed in detail. These issues cover topics such as government guarantees, trade secrets, international arbitration and contract management. This thesis study has been prepared based on the above-mentioned need. The main purpose of the study is to examine the legal dimension of PPP projects in Turkey in detail, to evaluate the practices applied in this field and to offer improvement suggestions.
