Abstract (EN)

The concept `Public Entity?, contrary to its importance in terms of administrative law, it appears that within the Turkish Law, there has not been enough studies on this matter. In the matter of Public Entity, though certain types have been outlined, the outcome of the absnce of legal definition has been an ongoing topic of discussion. Our goal is to determine the differences and to find out the followings; starting with the concept of `entity and public entity? , the process of coming to existence, the contents, the features, the criteria which differenciates public entity?s exclusive law and the research of the forms that shape up the Turkish Administrative organisations, it is worth mentioning that whether in doctrine or in judgement, the relevant controverstial issues, also the different views and approaches to the matter. In order to understand the concept of legal entity of public, legal entity should be understood. Because the public is primarily a legal person, legal entity. This situation has led to the need to referring to the civil law. The first part of this study is therefore has the character of explaining the concept of legal entity within the civil law. In the second and third sections, though we are aware that our modest effort is short of coming up with concrete proposals for a real treatment, butat least we have tried to identify the matter with a special focus, avoiding the unnecessary duplication of information.
