Abstract (EN)
The aim of this thesis is to establish the foundations of human rights in Kant's philosophy, starting from the human being and ethical viewpoint of Kant, thus linking Kant's thought of human rights with the understanding of human rights in the present. In the first part of our work, which consists of three main parts, Kant's human vision is addressed. The reason why our starting point is human is that our design of what human being is as an intelligent being actually determines all our thought system. This review contains Kant's thoughts on the potential of the human being, namely, how and why the possibilities he possesses, its dual nature, and how it exists as an ethical entity. In the second part, it is necessary to know what concepts such as freedom, the will, and duty which provide the condition of being an ethical entity are explained, what these concepts mean in Kant's ethical system and how they relate to each other. In the third part, we examined the relationship between human rights and Kant philosophy and tried to show the importance of the Kantian attitude by considering Kant's beliefs related to human rights. It is necessary to take a non-utilitarian understanding such as Kant's ethical view on the basis of human rights. Only because the value and honor of man can be adequately protected when we do not see it as a means to benefit. As a result, for Kant, we can say that human rights seem to be a condition for realization of human possibilities. Therefore, Kant's philosophy shows that if we can provide the necessary conditions as humanity, human rights and perpetual peace, which are the conditions for human beings to live like human beings, are possible.
