The subject of our study is the legal status of third parties who are entitled to a construction contract in return for flat. First of all, the general features of the construction contract in return for flat are examined within the scope of our topic. In this examination, general information is given about the definition, parties, elements, legal character, configuration, form, and provisions of the construction contract in return for flat. After that, the legal status of the third parties who are entitled to the construction contract in return for flat, which is the main subject of our study, is discussed. Followingly the legal status of the third parties who are entitled to the construction contract in return for flat, which constitutes the main subject of our study, has been discussed. In this regard, third-party entitlement forms are examined considering the contractor default of the contract, the impossibility of performance, and termination by paying full compensation, as well as a violation of the form in the contract. During our review, the problems faced by third parties who make transactions with contractor and land owner to own an independent section in practice were evaluated considering the opinions in the doctrine and the Turkish Supreme Court enforcement. In the last part of our study, ıt has been criticized and recommended that the current understanding should change by drawing attention to the negativities experienced due to the Turkish Supreme Court enforcement and lack of legal regulation in our legislation in terms of construction contract in return for flat.
