Abstract (EN)

Urban regeneration is a multi-dimensional transition process. Reasons that cause urban regeneration change according to time and space. Because of this, in Turkish law, there are four acts that regulate urban regeneration directly. These are Law no. 5366 on Renovationg, Conserving and Actively Using Dilapidated Historical and Cultural İmmovable Assets, Law no. 5104 on Northern Ankara Entrance Urban Regeneration Project, Lawno. 5393 on Municipality and Law no. 6306 on Redevelopment of Areas Under Disaster Risk. The subject of this study is determination and judicial review of urban regeneration areas that are within the scope of Law no. 6306. Three different statuses are prescribed in Law no. 6306. These are building under risk, area under risk and reserved settlement area. If urban regeneration implementation are carried out in accordance with Law no. 6306, the building or the area should be determined as one of these statuses. In this study, determination process views in the light of judicial precedents.
