Abstract (EN)

The mediation process in Türkiye commenced with the enactment of Law No. 6325 on Mediation in Civil Disputes which came into force on June 22, 2012. Through this relatively new practice, individuals holding the title of, Mediator, aim to alleviate the judiciary's workload. İn this study, we have sought to elaborate on the institution of mandatory mediation in rental disputes and its details. Under this practice, if the cases specified in the law are filed without first applying to a mediatör, the mandatory mediation requirement will be considered unfulfilled and the case will be dismissed on procedural grounds.Specifically, the institution of mandatory mediation in rental disputes, which came into force on September 1, 2023. Resolution of these disputes has often resulted in individuals resorting to litigation, prolonging judicial proceedings and turning the process into a protracted ordeal. İn such circumstances, the institution of mandatory mediation. The first section of the study, provides general information about mediation; while the second section explains fundamental aspects of rental law and rental disputes subject to mandatory mediation. In the final section, the application of mandatory mediation in rental disputes arising from rental law examined, highlighting issues and presenting occasional solution proposals.
