Abstract (EN)
In the age of technology and digitalization, "artificial intelligence" and "protection of personal data" become a current issue. The field of healthcare is one of the most important areas where artificial intelligence is used. In order to operate artificial intelligence applications in the health sciences, personal health data, which is under strict protection by data law, are required. With the illegal processing of personal data by artificial intelligence, data violation occurs; in some cases, although there is a legal processing activity, damages may occur due to algorithm bias. This thesis aims to determine the problems that may arise in the processing of personal health data by artificial intelligence in health sciences, to examine measures that can be taken against the problems, and to establish the liability of artificial intelligence in case personal health data is not protected. The first part of the thesis focuses on general concepts and legal regulations on artificial intelligence and personal data. In the second part, principles of processing personal health data are examined; and the personal health data processing of artificial intelligence, the consequences and measures for potential problems are discussed. In the third part, the legal remedies and liability determination against the damages occur as a result of processing of personal health data by artificial intelligence are emphasized.
