Credit card contracts

Credit card contracts contain mutual contracts which are concluded between; the cardmember, the card system organization and the member businesses. In Turkish written law these contracts are arrenged in the Law No. 5464, applicable by-law and Consumer Protection Law No. 6502. Cardmember agreement is concluded between the parties which are the card member and the card system organization. Cardmember conctracts are synallagmatic, consensual contracts. Also these are contracts of continious perfomance and have sui generis legal charecter. In cardmember contract card system organization provides card member to derive service and goods without using cash. On an equitable basis card member undertakes paying the prices of these service and goods to the card system organization. These contracts are considered as consumer credit if they contain the conditions in Consumer Law. Card acceptor agreement is concluded between the parties which are the card system organization and the member businesses. These third party beneficiary contracts are consensual and synallagmatic. In card acceptor contract member businesses provides service and goods to cardmember without taking cash. According to this execution card system organization pays the price of the service and goods which belongs to cardmember. The contracts are concluded between member businesses and cardmember are a part of credict card system. The contract's legal character, components and obligations can be various in each contract.
