The crime of purchase, receipt or possession of narcotics or psychotropic substances for personal use or use of narcotics or psychotropic substances

Narcotics or Psychotropic Substances, whose history dates back to ancient times, have always been the subject of curiosity among people and these substances encountered in almost every civilization around the world have since been used by sorcerers who believe that they let people gain extraordinary powers, and sometimes these substances have deceived people with their pleasure-giving features which are on special occasions abused and these substances have sometimes been believed to have healing power on diseases. With the emergence of harmful effects of narcotics and psychotropic substances and spread of the news about their effects by individuals who have become aware of their dangers, prohibitions have been introduced to these substances. However, despite the prohibitions imposed, there are still dozens of individuals who are misled by the false effects of these substances openly risking their lives, which results in individuals who are alienated from the society, posing potential danger for where they are located. The scope of this thesis study is within the subject matter of the regulation set forth in Article 191 of the Turkish Penal Code no 5237 regarding the crime of "Purchasing, Accepting or Carrying Narcotics or Psychotropic Substances for Use, or Using Narcotics or Psychotropic Substances". This regulation is handled on the basis of the general system of our Law. In the first chapter, information on some developments and regulations on narcotics and psychotropic substances in the past and present in the national and international area is provided, explaining which narcotics are to be considered within the scope of the definition of crime in TPC Article 191 in the group defining "Narcotics and Psychotropic Substances" with reference to their distinctive features and effects on those using them. These definitions are based on the types of narcotics or Psychotropic substances listed in the additional lists of the international conventions to which we are party. In the second chapter, the type of crime defined under Article 191 of the Turkish Penal Code no. 5237, entitled "Purchasing, Accepting or Carrying Addictive Narcotics or Psychotropic substances for Use or Using Narcotics or Psychotropic substances" was examined by classifying the elements of crimes within the framework of the general systematic of punishment. By addressing to, in particular, Law No. 5377 dated 29.06.2005", Law No. 5560 dated 19.12.2006", Law No. 6217 dated 14.04.2011"and Law No. 6545 on the Amendment of the Turkish Penal Code and Some Laws, the study was enriched with the sample decisions by examining the amendments made by the related regulations and the evaluations of the doctrine on this subject and the effects of these changes on the implementation of the laws.
