Abstract (EN)
The issue of taking cultural assets under protection in the international arena is considered one of the fundamental issues in terms of cultural rights. Cultural assets are an important treasure for defending our history and cultural identity. The importance of protecting them is no less than the importance of protecting any object. Because cultural heritage reflects the identity of individuals and societies. In international public law; It has been stated that human beings have cultural rights as well as civil, political, economic and social rights. In addition, it is accepted that every nation and nation in the world has a distinctive cultural identity and its own historical and cultural artifacts. Cultural assets are part of the country and one of their independent and personal formations, products uniquely created by the people of any country throughout human history. Cultural assets are a means of learning the identity of people and societies, a treasure trove of different information for any human community. Since these works express a lasting history and civilization, they cannot be compensated for anything else and cannot be valued with money. In this research, the issue of international protection of cultural assets in Iraq has been tried to be dealt with in detail. This is because there is a big problem regarding the competence of international treaties and organizations to protect the cultural assets in Iraq. In addition, it has been tried to clarify that the international community can play a positive role in this field. In this study, the issue of how much international law rules are applied to protect cultural assets in times of peace or armed conflict is also examined. Because the issue of preserving historical artifacts during the war is considered one of the important issues today. How can this not be an important issue? As a matter of fact, these conflicts continue to occur daily in different parts of the world. This issue is an important issue especially at international and national level. This research also focused on the developments in international treaties, conferences and organizations established to combat the people who destroy and steal historical artifacts.
