Özet (EN)

Cultural property is the heritage of human history. We know the human history with the help of this heritage. Today cultural property has a big importance not only for its economical value but also historical value. Many people and States want to have this property for this reason. Legal and illegal methods are used to reach this aim. Among them there are theft of cultural property, illegal export and illegal excavation. Cultural property is economically and pyscially damaged. To prevent the damage lots of rules are accepted in national and international regulations. One of them is the prohibition of taking abroad. Contravane to this rule is defined as a crime in many States. In this study cultural property protection in Turkish Law in general and the prohibition of taking abroad of cultural property specially are studied. The crime, contravane to the prohibition of illicit export, and its sanctions are studied in especial chapter. This study includes comparison of National regulations and international conventions. This study consist of two chapters. In the first chapter, the explanation of fundemental concept and words, history of Turkish cultural and natural property law and the regulation of today in Turkish Law are studied. In the second chapter, regulations on cultural and natural property in comparative law and international agreements are cited and compared with the similar crime typs and finally the prohibition of illicit export of cultural property and the crime contravane to this rule, and also returning the cultural property back to Turkey, are studied.
