Investigation of the conservation system in Turkey in the context of cultural heritage and human rights: The Historical peninsula case, istanbul

As a result of the development of the idea of human rights and its increasing importance in all areas, human rights have become more tangible in everyday life. With the introduction of the concept of 'cultural heritage for society', cultural heritage addressed in the context of human rights, and human rights have been involved in the relevant theory and practice of cultural heritage. The tendancy that aiming to ensure the protection of cultural heritage and the realization of human rights, has also led to alterations in the existing cultural heritage mentality. The present study aims to identify the characteristics that a cultural heritage system on a universal, national or local scale should have in order to be human rights-based and to form an evaluation model through case of Historic Peninsula, Istanbul. The study, argues the claim that a system where cultural heritage is protected through the protection of human rights will generate more successful consequences. In this context, three inter-related issues are discussed in the article. The study begins with explanation of the changes in the understanding of cultural heritage and the reflections of these changes in different aspects of heritage. Secondly human rights and the stage in which the idea of human rights reaches today is revealed. Following the examination of the place of cultural heritage theory and practice in human rights, finally the characteristics of the cultural heritage system based on human rights are presented as a synthesis. And the case study phase ensures to clarify the structure of human rights-based cultural heritage system. It has been revealed that the current conservation system of The Historic Peninsula does not conform to rights-based system, at the end of the study. This study is pioneering in determining the impact of human rights on cultural heritage idea and system; in addition, it aims to contribute to different disciplines such as law, economy and sociology.
