Abstract (EN)
Gambling is considered as a worthy concept to study in all societies, every religion, juridical and philosophical field. Every discipline approaches gambling with their own perspectives. For instance, while medical sciences approach gambling in terms of addiction and seek to find whether it is a disease or not, philosophy tries to find that whether it is a moral behavior or not. In obligations law, gambling debt is examined in terms of legal characteristics. In religions, gambling is examined in terms of divine orders. Gambling which concerns a broad field of study also deserves to be examined in terms of criminal law. As a matter of fact, Gambling is regulated as misdemeanor in the article 34 of the Misdemeanors Code No. 5326. The providing place and facility for gambling have been accepted as a crime in the article 228 of the Turkish Criminal Code (TCK) No. 5237. Our study composed of examining the relation of gambling with other fields as well as detailed examination of providing a place and facility for gambling crime issued in the article 228 of TCK.
