Abstract (EN)
Politically, rather than a legal principle meaning separation of powers is a principle that should be considered. Framework put forward by the principle of separation of powers is not only a judicial institution of legislative and executive powers to supervise and ensure stability, but rather by controlling the powers of the judiciary to secure individual freedom. In other words that should be guaranteed that judiciary is an erk to secure individual rights against the state judiciary.In this study, the perception of the principle of separation of powers has been carried out. In this regard, the scope of the study include the following questions:a)Has the judiciary in Turkey tried to do to protect their freedom by taking a role in stabilizing among other powers or survival of the state to ensure the political stability?b)Political stability in Turkey, the problem of separation of power arising from the interpretation of a system problem, is it wrong?Literature has been the method used to obtain data in this study. However, the research study, including lack of academic studies has led to resource limitations.As a result of research performed within the context of the principle of separation of powers, freedoms or guarantees provided by either the political stability, which have to be someone who stays in one of the preferred perceptions, were shaped. However, that freedom and political stability cannot be a substitute for each other and their jobs could be at the same time showing us, the study said that important evidence was obtained.
