Abstract (EN)

In our thesis study having ?Endorsement in Valuable Paper Law? topic; general information has been given as foreknowledge, and then without going into section separation, it has been mentioned about "endorsement? process in details. With the thought of providing benefits of our study in terms of application, we have especially specified on court of cassation decisions and the controversial ideas in doctrines. Endorsement is the alienation, putting in pledge of the rights that are bounded to the promissory bonds, or a declaration of will, which the bearer of the bond determines it with his/her writing, and confirms it by his/her signature in order to provide its collection. In order to provide the ownership of the bond, the endorsement process is not adequate by itself. In order to provide the alienation of the right connected to the promissory bond the endorsement process is not adequate solely. In order to provide this the owner of the bond in question must be transmitted to the assigned too. The endorsement divides into two as ?full endorsement? and ?white endorsement? according to the knowledge of whether the person who makes the endorsement is known or not. The endorsement which includes the name of the person, who makes the endorsement, is called as ?full endorsement?; and the endorsement which the name of the person who is making the endorsement is not known is called as ?white endorsement?. According the aim of making the process of endorsement; it is divided into three parts; named as ?alienatory endorsement?, ?procuration endorsement? and ?indorsement of pawn?. The name of the endorsement made for the target of alienating the rights that arises from a bond is ?alienatory endorsement?, the name of the endorsement that is made for collection is ?procuration endorsement? and the name of the endorsement which is for providing a guarantee to a debt is ?endorsement of pawn?. Unless it is understood that the endorsement is made for collection or pledge, an endorsement is accepted as alienatory endorsement.
