Abstract (EN)

We have discussed the universal principles of the fiqh (Islamic Law) that appear in the Majallah as law articles, that exist within the İslamic Fiqh, occur with the presence of the fiqh, expressed in the form of self-expression and that come to life in the detached parts of İbn-i Nuceym's work al-Eshbâh ve'n-Nezâir of Hanafi sect and Tacceddin es-Subkî's works of Shafii sect. When we make research we have chosen the Meydani work al-Lubâb fi Sharhi'l-Qitab as a source. Our thesis consists of there sections; in the introduction part we gave information about the importance, purpose and method of the thesis as well as information about the author's life and works. In the first section we have mentioned about principle and universal concepts, differences and similarities with similar concepts, the views of the scholars at the point of evidence of the Universal Fiqh Principle, self-knowledge about the historical development of the universal principles, well-known works in the field, parts and resources of the principles. In the second we have written up the Universal Fiqh Principles in the book of Lubâb which constitutes the backbone of our work along with the statements in the work and we have taken from the same work the examples which constitute the samples of the principle, by defining the concepts in the principle in terms of lugat (wordbook) and ıstılah (technical term). Important issues related to the Universal Fiqh Principles have been discussed and existing principles have been revealed. Keywords: Universal, principle, fıqh, hanefi.
