Dr. Murat TÜRE, 120 p.ABSTRACTThe basis of this study is Trademark Decree-Law No 556.This Decree-Law has beenprepared according to directive no 89/104 of European Community. Turkey needs of thischange because of demand of European Community membership and becoming membershipof Custom Community. It?s aimed that, the legislation of industrial Property Rights in ECharmonized with Trademark Decree-Law No 556When the topics are examined in this thesis, Trademark Decree-Law No 556, thedecision of Supreme Court and international agreements which Turkey is part in was stated.Historical progress of trademark, legal bases, functions of trademark and kinds oftrademark was examined in first chapter of this study.Establishing of infringement of trademark rights and the important criterions aboutestablishing of trademark rights was examined in second chapter of this study.The infringement of trademark rights and legal demands which can be wanted by theowner of trademark right was examined in third chapter of this study. Because trademarks,like other kinds of intellectual property rights give their owners some exclusive rights. Theinfringements are arranged in detail under provisions of article 9 and article 61.
