In our thesis, we attempted toanalyze/examine the unliquited damages which derived from trademarkinfringement.The person/persons who priate the trademark or attack the trademark in theforms prescribed in KHK (Decree Law),are statutorily obliged ( are liable ) tocompensate the injury of the trademark right and to right the contradiction tolaw. When the attack is in question, the owner of the trademark right can claimthe pecuniary and the general damages and also farthing (nominal) damagesprescribed in the KHK (Decree Law). While accounting the pecuniary damage,compensatory damage and the non-acquired profit (income) are taken intoconsideration separately. The non-acquired profit is accounted according to themethod chosen by the demander among the three choiced right prescribed bythe KHK (Decree Law). General Damage (compensation or reparations)Principle is that ?amount of a compensation does not exceed amount of injury?.This principle is not inoperative in accounting the compensation by attackingthe trademark right. While accounting the compensation, the person whoattacked will be acquired profit by the attack and this profit may be boughtaccording to KHK. Although this amount possibly exceed damages of injuredperson. An important issue is that owner of trademark right must be loss ofprofit because of the attack or whether unfair profit of person who attacked thetrademark Right is coherent remoteness connection by act of aggression.Furthermore, while accounting the non-acquired profit, coherent additionalvicompensation may be made according to economical significance of atrademark.vii
