Abstract (EN)
With regulating by the Industrial Property Code, offences against trademark rights are tried to be made up-to-date and effective in the fight against crime. In the Industrial Property Code, intangible assets, which are subject to six different industrial properties, namely trademark, geographical sign, traditional product name, design, patent, and utility model, are regulated. However, from these only trademarks are under a criminal protection shield. This reveals also the importance given by the legislator to the trademark right and its effort to protect the trademark right. Three different types of crime against trademark right are regulated by the Article 30 of the Industrial Property Code. Thus, infringement of trademark right through quotation or likelihood of confusion, removing the sign indicating the trademark protection and unauthorized legal acts are defined as offences. In our study, the crime of infringement of trademark right through quotation or likelihood of confusion, which is defined by the Article 30/1 of the Industrial Property Code, has been examined.
