Maurice Hauriou is a timeless and supra-disciplinary theorist whose contribution to the doctrines of administrative law and general public law is undeniable. Hauriou, one of the founders of French administrative law, has a direct or indirect part in all the concepts and institutions of administrative law literature today. In general, public law, it is expected that any comprehensive study will definitely refer to Hauriou's theories. Although Hauriou's contributions to public law are not limited to these two disciplines; these two disciplines are encountered as the cause or the result of his public law studies. The subject of this study is to find the relationship between administrative law and general public law in Hauriou doctrine both conceptually and theoretically and as a basic public law methodology. Hauriou, by finding solution proposals to the questions he observed in administrative law practice in the field of general public law; form his ideas and theories again by using administrative law tools. For this reason, it is not possible to separate the administrative law and general public law perspectives in Hauriou thought. In the introduction part of the study, Hauriou's academic life and his studies in administrative law and general public law were presented. These studies reveal that the author thinks of the two disciplines together, even on sight. So much so that for many years his studies in two disciplines have been dealt with in one book. The first half of the study is about the effect and contribution of general public law reasoning in Hauriou's administrative law ideas and theories. It can be discussed to which discipline the "personality of the state" issue, which is dealt with first, belongs, because "state" is a concept that transcends the boundaries of disciplines. However, Hauriou takes the personality of the state explicitly to arrive at an "administrative legal personality". For this, he had to determine the existence of the public law personality of the state and then separate it from the moral personality. Although Hauriou's thought changed from time to time, he finally revealed the objective character of the moral personality and evaluated the concept of legal personality as the recognition of this person by law. But Hauriou does not give an absolute and monist meaning to the state personality; in every discipline, this personality finds a different and disciplinary meaning. These disciplines, according to Hauriou, are subjective to the extent of the development level of their doctrines. State in a broad sense includes the administration; administration includes the state in the narrow sense. It is not possible to separate the personality of the state and the administration. On the other hand, since the personality of the state is one of the fundamental subjects of the general public law doctrine; Hauriou's reasoning in examining the personality of the state has largely developed within the doctrine of general public law. Hauriou's "Theory of Public Power," which shapes administrative law, is the second section of the section examining Hauriou's ideas on administrative law. Public power theory is particularly noted for its competition with the public service theory over which of the two concepts should be the criterion that determines the domain of administrative law. In the French administrative jurisdiction, this competition was contentious for many years, and there were periods when each of the two concepts was dominant in judicial decisions and doctrine. However, Hauriou, who declared that it is not important to the quality of the service provided to determine the field of administrative law, but to know whether the public power is used or not; on the other hand, is obviously a "public service theorist". As early as 1892, he identified the administration with the functioning of public services. Another point discussed in this study is that Hauriou is the name that established the "modern theory of public power", not an anachronistic theory of public power. The main determinant in the distinction between the way of authority and the way of management (or the operations of authority and the operations of management) that Hauriou makes in public power are the ideas of general public law. The way of authority is the sovereign's power to govern; the way of management is the manifestation of cooperation, solidarity, and a kind of "society" between the administration and individuals in the realization of public services. The second half of this study, crosswise with the first one, is aimed at showing the effect of administrative law issues and tools on Hauriou's reasoning in his theories that come to the fore in the field of general public law. Hauriou's theory of the state is the first issue addressed in this section. The approach of Hauriou's idea of the state to establish a balance between general public law and administrative law is clear. While administrative law treats the state as a subject of rights, for the general public law, the state is a social regime, a social life environment. In institutional theory, Hauriou identifies the system expressed as objective individuality or body with general public law; the complementary system expressed as a subjective personality or spirit with administrative law. Hauriou stands against the ideas of social contract. However, this is not because of the intellectual nature of contract theories, but because Hauriou sees the theories as fictional rather than reality. As a matter of fact, it is clear that he agrees with the contractual theorists in the idea of reciprocity in relations between administration and individual. Another reason is that the concordant will of the individuals cannot be the only element of the establishment of the state. Hauriou thinks that the manifestations of unity in "idea" can only be seen as one of the elements in the formation of the state. Although he is very close to the idea of a contract with his ideas of solidarity, Hauriou believes that the relationship between the state or administration and individuals is not a contract but a "situation of state (state of stability)" manifested in the idea of social static based on operational solidarity, which gives rise to the subject of law. According to Hauriou, the state is in a direct pursuit of justice, just like the law. Therefore, it creates spontaneously a state of law. Hauriou determines his place in legal theory as the demarcation line of subjective auto-limitation theory and right-rule theory. The administrative prerequisite privilege provides a temporary solution exception to the rule system. The reason is that public services require urgency and continuity. However, Hauriou thinks that temporary enforcement power is not exclusive to the administration. Temporary enforcement may also be in question for judgments and laws. There are three types of pre-executive powers of the three powers. These are the absolute legislative power, the res judicata power and the final decisionmaking power of the administration. The main distinction is not between these powers, but between temporary rules and established rules. The determinant of Hauriou's theory of the state is the three founding elements. These are society, the power of domination and the right to resist in the legal country. We also find Hauriou's search for balance in the elements of the state. Accordingly, the power of domination and the right to resist in the legal country come together in society and balance each other. In the thought of Hauriou, the power of domination does not equal sovereignty, but only meets the commandment sovereignty, which is a kind of it. Believing that sovereignty must be divided in order to speak of the limitation of the power of domination, Hauriou defines the subjugation sovereignty of the people that express individual freedoms and the state idea sovereignty, which manifests as constitutional status and established law, as other types of sovereignty. Hauriou puts forward a parallel theory with the idea of public power and its limitation in the theory of the power of domination. Hauriou's theories on the separation between the subject and the citizen and the legal country are susceptible to confusion with the "integral nationalist" ideas of Maurras. Carl Schmitt considers the existence of a team of leaders and elites who play a role in the foundation of the institution in theory of Hauriou as the principle of elitism. Indeed, the fact that Hauriou speaks of the existence of a moderate mass and the superior group of "excessifs" to which they should be exemplified may justify his analogy with nationalist theories. Moreover, Hauriou's principle of sacrifice praises the tolerance of the people against the corrupt institution. However, Hauriou later removed these concepts, which he theorized in 1896, from his theories; moreover, in 1903 it sanctified the right to resist oppression rather than sacrifice; he valued the resisting group of the people instead of the "excessifs". In the works of the later period, the need to limit the power of domination and public power is particularly net. However, rather than clearly abandoning the ideas of 1896, Hauriou preferred to ignore them; therefore, severe criticisms of his theory due to these ideas and concepts have survived. Nevertheless, it should be noted that, in Hauriou's works, there are no ideas that can be used as a basis for calling him "discriminatory nationalist". Similar criticisms are often based on inherently unfounded and unsupported ideas such as "excessifs" in Hauriou's early work; misunderstood terms such as the concept of "legal country", which has terminological unity with Maurras even though it essentially includes the right to resist and finally, it relies on its known conservative ideological identity. Since Hauriou was almost never at a radical pole in a theoretical debate, theorists who correctly analyzed Hauriou's method were able to interpret and use Hauriou's theories as a basis for their ideas. Carl Schmitt was perhaps the best analyst of the Hauriou's method. Even the names considered from the school of Hauriou did not reveal their method as a whole, since they take the starting point of Hauriou's method as a religious or sociological point of view. On the other hand, Schmitt has determined that both the idea of the state and the idea of the institution of Hauriou are the foundations of administrative law. The same analysis capability, in Turkey, is found in the Sıddık Sami Onar's investigation of Hauriou. Finally, the idea of the State of Hauriou, was seen in the works of Schmitt as the reason for the success of the Führer's ideology of exclusion and in the works of Onar, as the reason for the success of the unifying and integrating ideology of the republican period in Turkey. Since both names analyze Hauriou's method very well, although they show the same concept as a basis for two opposing actions, the reasoning of the two names leading to these conclusions seems correct. Hauriou's institutional theory occupies an important place in the general public law doctrine. To think of the institutional theory with the ideas of Hauriou dated 1896 would be unfair to the theory that reached its systematic integrity in 1925 and was completely free of the concepts of 1896 thought that were criticized. In his article of 1925, Hauriou poses the institutional theory with the stages of the objective individuality and the subjective personality of the institution and its elements, the idea of the work, the organized power, and the manifestations of communion. A widely criticized theory of Hauriou thought is the idea of social order in the face of justice. According to Hauriou, the state was born out of social order. Unlike other criticized concepts, social order is a concept that Hauriou has widely discussed and adopted in his later years. Social order is aimed at controlling dynamism which cannot be controlled otherwise due to the vital nature of the institution. According to Hauriou, social order meets the need for stability required by the state situation. The priority of the social order over justice is; it stems from the fact that social order is the minimum living condition and justice is a luxury. Justice is the dynamic demand for the "better" in a stagnation. Social order is to provide a stable and static state against a sudden danger. This is the only reason for priority. Therefore, this priority is not a hierarchy. According to Hauriou, the social order responds to the need for stability demanded by the state situation. The priority of social order over justice comes from the fact that social order is the minimum condition of life and justice is a luxury. Justice is the dynamic demand for the "best" in stability. The social order is to provide a stable and static state against sudden danger. This is the only reason for priority. Therefore, this priority is not a hierarchy. A manifestation of Hauriou's understanding of balance can be found in the thought of "the state as an institution". The State as an institution is a system of balances in Hauriou. The first equilibrium of the system is the separation of powers. The separation of powers, which he reconsidered with this thought, presents similar features with the theories of Aristotle and Rousseau. Three powers according to Hauriou; executive power, deliberative power, and suffrage power. This classification is a hierarchical order. According to Hauriou, the reason executive power is in the first place is the importance of the "execution" character of decisions. Hauriou's idea of a hierarchy of powers therefore contains direct traces of administrative law. The separate powers can cooperate on the one hand, and on the other hand they constitute a check and balance mechanism. The final manifestation of the balance system is the objective balance of forces. Hauriou builds a theory of general public law based on the idea of public power with the objective theory of auto-limitation. As a result, it was concluded that general public law is indispensable for administrative law and administrative law for general public law in Maurice Hauriou's thought. Moreover, it has been concluded that the relationship between administrative law and general public law constitutes the basis for Hauriou's every idea and theory of public law. Maurice Hauriou est un théoricien intemporel et supra-disciplinaire dont la contribution aux doctrines du droit administratif et du droit public général est indéniable. Hauriou, l'un des fondateurs du droit administratif français, a une part directe ou indirecte dans tous les concepts et institutions de la littérature de droit administratif d'aujourd'hui. En droit public général, on s'attend définitivement à ce que toute étude approfondie fasse référence aux théories d'Hauriou. Bien que les contributions d'Hauriou au droit public ne se limitent pas à ces deux disciplines ; ces deux disciplines sont rencontrées comme cause ou comme résultat de ses études de droit public. L'objet de cette étude est de trouver la relation entre le droit administratif et le droit public général dans la doctrine Hauriou à la fois conceptuellement et théoriquement et comme méthodologie de base du droit public. Hauriou, en trouvant des propositions de solutions aux questions qu'il a observées dans la pratique du droit administratif dans le domaine du droit public général ; reformer ses idées et théories en utilisant des outils de droit administratif. Pour cette raison, il n'est pas possible de séparer les perspectives de droit administratif et de droit public général dans la pensée Hauriou. Dans la partie d'introduction de l'étude, la vie universitaire d'Hauriou et ses études en droit administratif et en droit public général ont été présentées. Ces études révèlent que l'auteur pense aux deux disciplines ensemble, même à vue. À tel point que depuis de nombreuses années, ses études sur deux disciplines ont été traitées dans un seul livre. La première moitié de l'étude porte sur l'effet et la contribution du raisonnement de droit public général dans les idées et théories de droit administratif d'Hauriou. On peut discuter à quelle discipline appartient la question de la « personnalité de l'État », qui est traitée en premier, parce que « l'État » est un concept qui transcende les frontières des disciplines. Cependant, Hauriou prend explicitement la personnalité de l'État pour arriver à une « personnalité juridique administrative ». Pour cela, il a dû déterminer sur l'existence de la personnalité de droit public de l'État et la séparer ensuite de la personnalité morale. Bien que la pensée d'Hauriou ait changé de temps en temps, il a finalement révélé le caractère objectif de la personnalité morale et évalué le concept de personnalité juridique comme la reconnaissance de cette personne par la loi. Mais Hauriou ne donne pas un sens absolu et moniste à la personnalité étatique ; dans chaque discipline, cette personnalité trouve une signification différente et disciplinaire. Ces disciplines, selon Hauriou, sont subjectives dans la mesure du niveau de développement de leurs doctrines. La seconde moitié de cette étude, en croisement avec la première, vise à montrer l'effet des enjeux et des outils de droit administratif sur le raisonnement d'Hauriou dans ses théories qui viennent au premier plan dans le domaine du droit public général. La théorie de l'État d'Hauriou est la première question abordée dans cette section. L'approche de l'idée d'Hauriou de l'État pour établir un équilibre entre le droit public général et le droit administratif est claire. Alors que le droit administratif traite l'État comme un sujet de droits, pour le droit public général, l'État est un régime social, un milieu de vie sociale. Dans la théorie institutionnelle, Hauriou identifie le système exprimé en tant qu'individualité objective ou corps avec droit public général ; le système complémentaire exprimé en tant que personnalité subjectif ou esprit avec le droit administratif. Hauriou s'oppose aux idées de contrat social. En fait, il est clair qu'il est d'accord avec les théoriciens du contrat dans l'idée de réciprocité dans les relations entre l'administration et l'individu. Une autre raison est que la volonté harmonieuse des individus ne peut être le seul élément de l'établissement de l'État. Hauriou pense que les manifestations d'unité dans « l'idée » ne peuvent être vues que comme l'un des éléments de la formation de l'État. S'il s'est rapproché de l'idée de contracter avec des idées de solidarité, Hauriou estime que la relation entre l'État ou l'administration et les individus n'est pas un contrat mais une « situation d'état » qui se manifeste dans l'idée de statique sociale basée sur la solidarité opérationnelle, qui donne lieu au sujet de droit. Selon Hauriou, l'État est en quête directe de justice, tout comme la loi. Par conséquent, il crée un état de droit spontanément. Hauriou détermine sa place dans la théorie juridique comme la ligne de démarcation de la théorie subjective de l'autolimitation et de la théorie de la règle de droite. Cependant, Hauriou pense que le pouvoir exécutif provisoire n'est pas exclusif à l'administration. L'exécution temporaire peut également être en cause pour les jugements et les lois. Il existe trois types de pouvoirs pré-exécutifs des trois pouvoirs. Celles-ci sont l'autorité de la chose légiférée, l'autorité de la chose jugée et l'autorité de la chose décidée. La principale distinction n'est pas entre ces pouvoirs, mais entre les règles temporaires et les règles établies. Les trois éléments fondateurs sont le déterminant de la théorie de l'État d'Hauriou. Ce sont la société, le pouvoir de domination et le droit de résister dans le pays légal. On retrouve aussi la recherche d'équilibre d'Hauriou dans les éléments de l'État. En conséquence, le pouvoir de domination et le droit de résister dans le pays légal se rejoignent dans la société et s'équilibrent. Dans la pensée d'Hauriou, le pouvoir de domination n'égale pas la souveraineté, mais rencontre seulement la souveraineté de commandement, qui en est une sorte. Estimant que la souveraineté doit être divisée pour parler de la limitation du pouvoir de domination, Hauriou définit la souveraineté de la sujétion du peuple qui exprime les libertés individuelles et la souveraineté de l'idée d'État, qui se manifeste par un statut constitutionnel et une loi établie, comme d'autres types de souveraineté. Hauriou propose une théorie parallèle avec l'idée de puissance publique et sa limitation dans la théorie du pouvoir de domination. Les théories d'Hauriou sur la séparation entre le sujet et le citoyen et le pays légal sont susceptibles de confusion avec les idées « nationalistes intégrales » de Maurras. Carl Schmitt était peut-être le meilleur analyste de la méthode Hauriou. Même les noms considérés comme issus de l'école Hauriou n'ont pas révélé leur méthode dans son ensemble, puisqu'ils prennent le point de départ de la méthode d'Hauriou comme point de vue religieux ou sociologique. D'autre part, Schmitt a déterminé que tant l'idée d'État que l'idée d'institution d'Hauriou sont les fondements du droit administratif. La même capacité d'analyse, en Turquie, se retrouve dans l'enquête d'Hauriou de Sıddık Sami Onar. Enfin, l'idée de l'État d'Hauriou, a été vue dans les œuvres de Schmitt comme la raison du succès de l'idéologie d'exclusion du Führer et dans les œuvres d'Onar, comme la raison du succès de l'idéologie unificatrice et intégratrice du début de la période républicaine en Turquie. Puisque les deux noms analysent très bien la méthode d'Hauriou, bien qu'ils montrent le même concept comme base de deux actions opposées, les raisonnements des deux noms conduisant à ces conclusions semble correct. La théorie institutionnelle d'Hauriou occupe une place importante dans la doctrine générale du droit public. Penser la théorie institutionnelle avec les idées d'Hauriou datées de 1896 serait injuste pour la théorie qui a atteint son intégrité systématique en 1925 et était complètement libre des concepts de pensée de 1896 qui ont été critiqués. Dans son article de 1925, Hauriou pose la théorie institutionnelle avec les étapes de l'individualité objective et de la personnalité subjective de l'institution et de ses éléments, l'idée de l'œuvre, le pouvoir organisé et les manifestations de communion. Une théorie largement critiquée de la pensée Hauriou est l'idée d'ordre social face à la justice. Selon Hauriou, l'État est né de l'ordre social. Contrairement à d'autres concepts critiqués, l'ordre social est un concept que Hauriou a largement traité et adopté ses dernières années. L'ordre social vise à contrôler le dynamisme qui ne peut être contrôlé autrement en raison de la nature vitale de l'institution. Selon Hauriou, l'ordre social répond au besoin de stabilité qu'exige la situation étatique. La priorité de l'ordre social sur la justice vient du fait que l'ordre social est la condition de vie minimale et la justice est un luxe. La justice est la demande dynamique du « meilleur » dans une stabilité. L'ordre social est de fournir un état stable et statique contre un danger soudain. C'est la seule raison de priorité. Par conséquent, cette priorité n'est pas une hiérarchie. Une manifestation de la compréhension d'Hauriou de l'équilibre peut être trouvée dans la pensée de « l'État en tant qu'institution ». L'État en tant qu'institution est un système d'équilibres à Hauriou. Le premier équilibre du système est la séparation des pouvoirs. La séparation des pouvoirs, qu'il a reconsidérée avec cette pensée, présente des traits similaires avec les théories d'Aristote et de Rousseau. Trois pouvoirs selon Hauriou ; pouvoir exécutif, pouvoir délibérant et pouvoir de suffrage. Ce classement est un ordre hiérarchique. Selon Hauriou, la raison pour laquelle le pouvoir exécutif est en premier lieu est l'importance du caractère « d'exécution » des décisions. L'idée d'Hauriou d'une hiérarchie des pouvoirs porte ainsi des traces directes du droit administratif. Les pouvoirs séparés peuvent coopérer d'une part, et d'autre part elles constituent un mécanisme de frein et d'équilibrage. La manifestation finale du système d'équilibre est l'équilibre objectif des pouvoirs. L'idée d'Hauriou d'une hiérarchie des pouvoirs contient donc des traces directes du droit administratif. Les pouvoirs séparés peuvent coopérer d'une part, et d'autre part elles constituent un mécanisme de frein et d'équilibrage. La manifestation finale du système d'équilibre est l'équilibre objectif des forces. Hauriou construit une théorie du droit public général basée sur l'idée de puissance publique avec la théorie objective de l'autolimitation. En conséquence, il a été conclu que le droit public général est indispensable pour le droit administratif et le droit administratif pour le droit public général dans la pensée de Maurice Hauriou. De plus, il a été conclu que la relation entre le droit administratif et le droit public général constitue la base de chaque idée et théorie du droit public d'Hauriou.
