Guardianship is a legal institution established to protect the interests of minors who are not under custody and adults who need to be protected. In Turkish Law, persons under guardianship are represented by real persons called guardians. The capacity of these people to use their civil rights is limited with the decision to put them under guardianship. Therefore, minors or adults, who are limited with guardianship, cannot take legal actions on their own. However, in special cases specified in the Turkish Civil Code, there is the freedom to take certain legal actions and to use their rights personally. In this thesis, it is aimed to explain the situations in which persons with limited capacity can do all the proceedings related to the follow-up of the case as plaintiff or defendant in civil procedure law in person or through their legal representative, in line with the legal regulations, the current situation in practice and various views in the doctrine.
