Abstract (EN)

Mehmet Zihni Efendi is an Ottoman jurist who lived in the last period of the Ottoman Empire and wrote in many Islamic sciences such as Islamic law, Arabic, history, hadith, akaid and sufism.The author's work named Ni'met-i İslâm constitute the source of the catechisms in Turkey. It is also important in that it includes the issues of marriage and divorce which are not included in other catechisms. The work was written according to Hanafi views. The Ottoman law of family rights is also a text of the law prepared during the same period with Ni'met-i İslâm. Although it was written according to Hanafi sect it sometimes left the practice of Hanafi and accepted the opinions of the other sects and made individual choices in some subjects. It has influenced the family law of many İslâmic countries and in some countries has been applied until recently. It will be useful to examine and compare make inferences the principles of these two works about divorce which is important, a sensitive issue and a serious problem in field the family law today.
