Abstract (EN)

Burhâneddin el-Merginânî's work entitled el-Hidâye, considered one of the most important works of the Hanafi school of jurisprudence in the period's fiqh literature, is a comparative fiqh book. The main objective of this study is to systematically present the views attributed to Imam Shafi'i in al-Hidâye, to evaluate these attributions scientifically by comparing them with classical Shafi'i school sources, and to determine the degree of accuracy of these attributions. Within this framework, the thesis first presents a general overview of Merginani's scholarly personality, his fiqh methodology, and the process of writing al-Hidaya. Subsequently, the views attributed to Imam Shafi'i in the work are classified, primarily considering the fundamental areas of fiqh, such as worship and transactions. These identified views are examined in light of Imam Shafi'i's own works and the fundamental sources of early Shafi'i jurists; the extent to which the views coincide in terms of wording, content, and evidence is analyzed. Thus, it has been established that some opinions belong directly to Imam Shafi'i, while others may be intra-school interpretations or the preferences of later Shafi'i jurists. In order to identify and evaluate the views attributed by Merginani, reference was made to many classical sources of the Shafi'i school of thought, primarily Imam Shafi'i's al-Umm, as well as Shirbini's Mughni al-Muhtaç, Shirazi's al-Muhazzab, and others. As a result of the findings and analyses, it was concluded that Merginani was incorrect in 78 of the views he attributed. Our study aims to shed light on the presentation of Shafi'i views in Hanafi literature and to contribute to the scientific examination of the issue of inter-school attribution.
