Molla Husrev?s point of views on walâ and debates over this topic among ottoman scholars (According to the risâlas of Walâ)

Our study on walâ which is concerned the causes of the heritage in Islamic Heritage Law contains the explanation of walâ , and the evaluations of Ottoman Scholars over risâlas of walâ as well. In addition, this topic has great importance in terms of including much more things about discussions related to sects among Ottoman Scholars in rising term of Ottoman Empire.The concept of walâ is evaluated as Heritage Law sub-item of the Islamic Heritage Law. Actually, the concept of walâ which is defined up-close as legaly depends on the system of the slavery we may say. On the one hand, the religion Islam has provided slaves with many opportunities to have humanitarian living conditions also on the other hand, Islam has encouraged people who were owner the slaves to liberate them. In this point, one of the encouragements is to have a right as being heritor with the liberation of the slaves.Nowadays, we don?t need to use the concept of walâ and there isn?t any popularities anymore with using it. Being heritor by walâ remained as a historical phenomenon with ending of the slavery. In different times, there were debates and precious evaluations on walâ issue which has a historical manner in Islamic Heritage Law.In the risâla on the issue of the walâ which was written by Molla Hüsrev consisted of the things out of classical Hanefi attitudes and also he was encountered strong criticism regarding with these new ideas. And also, this strong criticism took place widely as unique risâla.Our study comprises of informations on Molla Hüsrev?s whole life, his personality, his publications and the evaluations of the concept of walâ according to Islamic Law. In addition, it has the translation of risâla about the concept of walâ. We have tried to give our views and perspectives obtained from risalas as well.
