Abstract (EN)

In this work, the effect of credit transfer on the relationship of money debt and the risks that arise from this payment transaction is evalued. The subject is discussed in three main parts. The first part includes the explanation of the legal grounds which are necessary for the payment via credit transfer. In this regard, money debt, noncash payment and credit transfer concepts are mentioned and later the legal structure of credit transfer is analysed. In the second part, the conditions which are required for the effect of fulfillment on the value relationship are determined. In this aspect, it is discussed whether deposit money is within the framework in the object of debt, and also the necessary conditions for the payment via credit transfer to be appropriate in time and place. Finally it is tried to be established that the credit transfer is required to be made by whom and to whom. The third part is reserved to the consequences of a credit transfer which is not performed in accordance with the conditions determined in the previous part, as the ?non timeliness of payment? and ?non-execution of the payment?. Under the title of non timeliness of the payment, responsibility of the debtor towards the creditor and the responsibility of the bank towards the transferor is discussed. Under the title of non-payment, it is tried to be determined that under which conditions the debtor is considered to be discharged from the debt, in the meaning of the transfer of the risk of loss to the creditor.
