Abstract (EN)

Marriage contract (nikâh) is an agreement of marriage in order to unite the lives of men and women in accordance with the terms of shar'i methods and Islamic law. Islam approves marriage as halal and renders the illegitimate relationship as forbidden. The main aim here is to protect next generations which is one of the main ideals of Islam, and thus to create a sound society. A number of legal consequences of the marriage, which constitutes the first step in the formation of the family, come to the foreground and marriage imposes financial responsibilities on the parties. Giving mahr to wife is foremost responsibility of husband. Though there existed in pre-Islamic cultures of almost all religions and societies, practices similar to mahr cannot be regarded as meahr.
