Abstract (EN)

Islam religion orders to protect and take care of the orphans rights in every condition. The majority of the people and state administrators of Ottoman State are the members of Islam religion. This membership is the main reason for the sensitivity of the orphans and their rights throughout the history of the Ottoman Empire. This protection was provided through the waqfs until the imperial edict of reorganization. In the next period, it has gained an official identity with the orphanages and the educational institutions established for orphans established by the state itself. Apart from the care and education of the orphans, Emvâl-i Eytâm Ministry was established in 1268/1851 for the protection and increase of orphan assets, which is another important issue. The operation and management of the courtesy was regulated in the regulation titled "Eytâm Regulation" issued with the approval of the Seyhulislamlik establishment and the Sultan. After the first regulation, other regulations, additions and amendments related to the operation of orphan assets were issued. The most comprehensive of these was the one published in 1324/1906 with the title "Umûm Emvâl-i Eytâmın Sûret-i İdâresi Hakkında Ta'dîlen Kaleme Alınan Nizamnâme". In this thesis, Eytâm Regulation of 1324/1906 is dealt with the fiqh scholarship in a comperative way. In connection with this main topic; historical process of the protection of orphans rights; introducing the previous regulations regarding orphan assets and the regulation dated 1324/1906; the transcription of the articles of the last regulation and their writing in an understandable way in Turkish are also included in this thesis.
