The crime of the invasion of privacy

One of theintangible wealt that a person enjoys is private life. Theright to privacy and protection of private life a person enjoys over this intangible wealt was regulated in three titles as privacy of private life, fredoom of communication and inviolability of the domicile in between the article 20 and the article 22 of the Constitution. In addition, the article 8 of the European on Human Rights entitled as ''Respect to Private and Familiy Life'' includes the regulation that protects private life, family life, fredoom of communication and inviolability of the domicile. In Turkish law, the invasion of privacy was regulated as crime for the firs time in the article 134 of Turkish Criminal Code Nr. 5237, second volüme, second chapter, ninth section entitled as ''Offenses aganist Privacy and Secrecy of Life''. The purporse of this study is to identify the boundaries of private life that a person enjoys to improve and become aware of his/her personality, also the boundaries of private life that a person shares with the people close to him and keeps the others out of them. It aims to reveal the scope of privacy and the National and Internetional Law perspective on private life. This study examines crime of the invasion of privacy and its structural elements in all its parts.
